And may the flame in our hearts guide us on all of our ways.” -Hedwig Wilhelmova Sakharov, 1st Herald of the Protectorate and Voice of its People May 2668     During the rest of the Document EP is used as an abbreviation for the Elysium Protectorate. ------------------------------------------------------------------------------------------------------------------------ Part I — Definition and objectives of the Elysium Protectorate Section 1 — Territorial Scope and Protectorate Membership (a) The constitution applies to the territories of the Members of the EP (b) EP membership shall be open to all Nations, Planets, and Cities which respect the values of our union and are committed to promoting them together. In order to prevent a serious breach of the fundamental rights of a Member Entity, the Cloud may address recommendations to that Entity. If the Cloud finds that a Member State has seriously and consistently breached the values of the Union, it may decide to expel this Member Section 2 — Values of the Elysium Protectorate (a) The EP is founded on the values of respect for people's dignity, freedom, democracy, equality, the rule of law, and respect for people's rights. This includes peoples of all species, genders, etc. (b) As a special note, the EP allows every citizen to choose their sexual partners however they desire. There is no persecution for choosing someone from a different species. As long as it is consensual, any injuries that are a result of incompatibility will not be persecuted by law Section 3 — Customs Union (a) The EP will become a Customs Union and thus reduce tariffs and regulations between its members as much as possible. Through this trade between the members, peace and understanding will bloom and competition will be healthy (b) Due to the nature of this Customs Union, no member is allowed to negotiate trade agreements with a third-party entity. Trade agreements are only negotiated by the EP as a whole Section 4 — Objectives The EP aim is to promote peace, its values, and the wellbeing of its peoples. It shall provide its citizens with an area of freedom, security, and justice without internal frontiers and an internal market where competition is free and undistorted. The EP shall work for the sustainable development of its territories. It shall respect its rich cultural diversity and shall ensure that the cultural heritage is safeguarded and enhanced. The EP shall uphold and promote its values and interests in its relations with the other polities and the rest of the Iron Stars. It shall contribute to peace, security, solidarity, and mutual respect among peoples, and free and fair trade. Part II — Political Structure, the Herald and Defense of the Elysium Protectorate Section 1 — Overview of the Political Structure The EP consists of three representative bodies. The Elysian Cloud, The Protectorate Committee, and The Protectorate Parliament. Section 2 — Elysian Cloud (a) The Elysian Cloud consists of the Herald of the Protectorate, the Director General of the EP Military Staff, the High Representative for Foreign Affairs, the leader (or a representative) of every member of the EP, and a chosen group of civilians and military personnel with higher importance to the EP (b) The Elysian Cloud as the name suggests sits above the regular political work and is there to give the EP a vision for the future and a direction on how to act. The Cloud is the political body that represents the EP in negotiations with other polities, in cases where the Herald isn't enough. The Cloud negotiates trade agreements and it shares budgetary powers with the Protectorate Parliament (c) During the formation of the EP and at every moment the Parliament and Committee are unavailable, the Elysian Cloud will possess executive and legislative capabilities. (d) Meetings are held at least once per month, the Herald of the Protectorate is the Voice of the Cloud during those meetings. Presidency of the Cloud changes every meeting, a rotation should ensure that every Member gets to lead the highest body once in a while and can voice its concerns. Section 3 — Protectorate Committee (a) The Protectorate Committee shall promote the general interest of the Protectorate and take appropriate initiatives to that end. It is the executive body of the EP. Its main tasks are to ensure the application of the Constitution and measures adopted by the institutions, to oversee the application of Protectorate law, implement the budget, and manage programs. (b) Lead by the Herald of the Protectorate, it shall also be responsible for the EP's external representation. (c) Its members are selected from persons whose independence can be fully guaranteed by virtue of their general competence and commitment to the Protectorate. The composition is limited to one person per Member. Section 4 — Protectorate Parliament The Protectorate Parliament shall exercise legislative and, with the Cloud, exercise budgetary powers. It shall also exercise powers of political scrutiny and consultation. It shall elect the Herald of the Protectorate by a majority of its Members, on a proposal from the Elysian Cloud. This strengthens the political link between all three bodies of the EP. The Constitution sets the number of Members of the Protectorate Parliament at 200 but leaves it to the Elysian Cloud to determine its composition, provided that the number of seats ranges between 2 and 30 seats for each Member State. Members of the Protectorate Parliament are elected for five years by direct universal suffrage. Section 5 — Herald of the Protectorate (a) As the head of the Protectorate Committee, the executive branch of the Protectorate, the Herald is the highest-ranked representative of the EP. (b) Should in any vote in any of the three bodies a tie occur, the Herald will get a vote or ist vote is doubled. This way the Herald will break any ties (c) The Herald of the Protectorate shall be appointed by the Elysian Cloud and elected by the Protectorate Parliament by a majority of its members. A term lasts five years and the is no limit to how many terms a Herald can serve. Due to the special way the 1st Herald was chosen, her first term will end after one year. Section 6 — Military and Director General of the EP Military Staff (a) All Member Military joins the EP Military, this includes any military holdings. But for the time being the military stays where it is (b) All former ranks will be adjusted to the EP Military ranking system (c) The Director-General of the EP Military Staff is the highest-ranked military member in the EP military and the leader of the forces in peace and war. He gets appointed by the Herald of the Protectorate and thus the term equals the Heralds term Section 7 — Trade and High Representative for Foreign Affairs and Trade (a) As a Customs Union trade with outside entities is negotiated by the Elysian Cloud (b) The High Representative for Foreign Affairs and Trade plays a special role, appointed by the Herald and bound to its term, the High Representative is allowed to negotiate mutually beneficial trade deals on her own if she is not acting against the Elysian Cloud (C) The High Representative is also the first adviser to the Elysian Cloud and the Herald in matters of foreign polities Part III — Citizens and Members of the Elysium Protectorate Section 1 — Taxes (a) All member planets will pay a tax of 1 credit per citizen to the EP that will be used for the EP budget Section 2 — Citizens Rights (a) Slavery in all forms is not permitted in the EP (b) Every Citizen or visitor of the EP enjoys the right of free speech and fair and just trials   Part IV — General and final provisions Section 1 — Declaration of War (a) Each member needs to supply the able recruits to fill the ranks of the EP military if they are asked to do so (b) Declarations of War shall only be made by a majority vote by the Elysian Cloud, the Committee, and Parliament. The vote of the cloud counts as two and the Herald breaks ties (c) Should any member be the target of an attack, it is counted as an attack against every member of the EP and is seen as a declaration of war against the EP as a whole Section 2 — Religion (a) Every Citizen can choose its faith without being forced to do so (b) Due to the history of Heras, places of worship for gods are only allowed in the territory of one member. To avoid the reappearance of an MES entity worship and festivities for those entities are limited to the city that houses the places of worship. Religions from outside of Heras are allowed to spread and gods and goddesses be worshipped everywhere without limitation, as they never manifested themselves to wage war
